Repossession Notice

ATTENTION CUSTOMER: YOU ARE BEING NOTIFIED IN ACCORDANCE TO THE TEXAS MOTOR VEHICLE LAWS, SECTION 70.001 THAT YOUR VEHICLE MAY BE SUBJECT TO REPOSSESSION FOR RETURNED CHECKS, SUCH AS INSUFFICIENT FUNDS, ACCOUNT CLOSED, STOPPED PAYMENT, OR STOLEN CHECKS. CREDIT CARDS APPLY THE SAME WAY. YOU WILL ALSO BE OBLIGATED TO PAY FOR THE COST OF, BUT NOT LIMITED TO, ANY REPOSSESSION AS A CONDITION OF RECLAIMING THE VEHICLE. YOUR VEHICLE WILL BE REPOSSESSED FOR NONPAYMENT OF SERVICES/REPAIRS IN FULL.

Repair Authorization

I hereby authorize the repair work to be done along with the necessary parts and materials and hereby grant you and/or your employees permission to operate the vehicle herein described on streets, highways or elsewhere, at your discretion.

An express mechanic's lien is hereby acknowledged on the above vehicle to secure the amount of repairs thereto, unpaid. I understand that dealer/owner is not responsible for delay or other consequences due to the unavailability of parts or shipment beyond their control. Quotations on parts and/or repairs are subject to change.

Estimate Is Preliminary

I understand that any estimate provided is based on a visual inspection and/or preliminary assessment of visible damage only. I understand that additional damage, parts, or labor not visible or identifiable until the vehicle is disassembled may be discovered during the repair process, and that the final repair cost may differ from the original estimate as a result. I authorize Santa Ana Body Shop / Tomball Collision to proceed with repairs based on the most current estimate, including any supplements, and understand I will be notified of material changes in scope or cost before additional work is completed where reasonably practicable.

NOT RESPONSIBLE FOR DAMAGE OR ARTICLES LEFT IN CAR IN CASE OF FIRE, THEFT OR ANY OTHER CAUSE BEYOND OUR CONTROL.

Storage, Administration & Impound Fees

A storage fee of $75.00 per day, an administration fee of $395.00, and an impound fee of $20.00 will apply to all stored vehicles, totaled vehicles, or vehicles left more than 2 days after repairs are completed.

Teardown & Inspection Authorization

REPAIR AUTHORIZATION: ANY REPAIR $500.00 AND UP. I hereby authorize the teardown and inspection of the above vehicle. I understand that the vehicle will be disassembled to evaluate all damaged areas and that the disassembly will prevent reassembly of the vehicle as received.

Payment Responsibility

We work for you, not for the Insurance Company. Therefore, responsibility of payment for repairs will be yours when your vehicle is completed. Please make sure your payment arrangements are done before you pick up your vehicle. NO personal checks will be accepted.

I hereby authorize payments for goods/services received and therefore will not dispute any payments with my credit card company or insurance company so long as the transaction corresponds to the terms indicated in this form.

I AUTHORIZE STORAGE OF MY VEHICLE AND/OR I AUTHORIZE THE RELEASE OF MY VEHICLE FROM STORAGE LOT.

Special Power of Attorney

IN CONSIDERATION OF SERVICES PERFORMED, THE UNDERSIGNED DOES HEREBY CONSTITUTE AND APPOINT SANTA ANA AUTO BODY SHOP AS MY ATTORNEY IN FACT AND IN MY NAME, PLACE AND STEAD TO EXECUTE AND SIGN ON MY BEHALF ANY AND ALL PAPERS OR DOCUMENTS NECESSARY TO OBTAIN FULL PAYMENT, SETTLEMENT AND SATISFACTION FROM INSURANCE COMPANY OR ANY THIRD PARTY IN THE AMOUNT REPRESENTING THE LOSS AND DAMAGE SET FORTH IN THE PROOF OF LOSS WHICH I HAVE EXECUTED AND FORWARDED TO SANTA ANA AUTO BODY SHOP.

Responsibility if Insurance Does Not Pay

I understand that I, as the vehicle owner, am ultimately responsible for payment of all repair charges. If my insurance company does not pay any portion of the repair cost in full within 30 days of being billed, or denies coverage for any part of the repair, I agree to pay the unpaid balance directly to Santa Ana Body Shop / Tomball Collision within 15 days of being notified of the unpaid amount.

Inter-Location Transfer Authorization

I hereby authorize Santa Ana Body Shop to allow vehicles to be transferred between all Tomball Collision and Santa Ana Body Shop locations for repairs.

Entire Agreement

This Authorization, together with any signed estimate(s) and supplement(s), constitutes the entire agreement between me and Santa Ana Body Shop / Tomball Collision regarding the repair of my vehicle, and supersedes any prior or contemporaneous oral discussions, representations, or understandings on the subject. Any changes to this Authorization must be made in writing and signed by both parties.

Electronic Signature Acknowledgment

By signing below, Customer acknowledges that this electronic signature carries the same legal weight as a handwritten signature pursuant to the federal ESIGN Act (15 U.S.C. § 7001) and Texas Business & Commerce Code § 322 (UETA). Customer confirms they have read and understood this entire agreement and are the registered owner or authorized agent for the described vehicle.

This document is legally enforceable under the federal ESIGN Act (15 U.S.C. § 7001) and Texas Business & Commerce Code Chapter 322 (UETA).
